Supreme Court says No Degree without the Final Year Exam, upheld UGC stand

One of the most awaiting decision for final year students the Supreme Court (SC) has now given verdict on whether the final year exam will be conducted or not across India. Now, the SC verdict is out and we have bad news for the final year students as the exam will not be cancelled and it has to be conducted even if it is delayed.

Supreme Court uphelds University Grants Commission (UGC) 6th July 2020 circular and states that “SC said no state can promote final year students without final examination as ordered by UGC amid the COVID-19 pandemic”.

For the containment zone colleges and university the SC said that these universities should contact UGC for new schedule of exam as per their convenience. The SC further added that “Court says States must hold exams to promote students. It says states under Disaster management Act can postpone exams in view of pandemic & can consult UGC to fix dates”

As per the UGC the final year exam has to be conducted before 30th September 2020. Supreme Court strictly said that “SDMA cannot direct to pass students based on previous performance and States/UTs cannot pass students without exams as directed by UGC.

Alakh Alok Srivastava a lawyer tweeted “In #UGC Judgment, Supreme Court has recorded most of my submissions, including my request to adopt MP Model. But apparently it has been left to the States. States also authorised to Postpone Exams. I will request state Govts to go for Online & Home Based final year Exams only.”

Many students took to twitter to ask for the same judgement and decision from NTA for JEE main and NEET exams this year for which students want to be postponed.
